Scarsdale Lawyer Arrested for Travelling to Cuba

cubaAccording to a December 3rd story in the Journal News , a lawyer from Claremont Road in Scarsdale was arrested for taking a business trip to Cuba in violation of the Federal embargo. In a criminal complaint filed by the US Attorney’s Office for the Southern District of New York, Marc Verzani of Scarsdale is charged with travelling to Cuba with Adem Arici of Brooklyn in September. At the time the two inspected Arici’s business and real estate investments and looked for properties to purchase. Arici is said to have invested millions of dollars in Cuba. In addition, the two are charged with spending money in Cuba, a violation of U.S. law.

Federal agents arrested Verzani, age 45, and Adem Arici, age 49, of Brooklyn on Thursday December 1 and charged them with conspiring to violate the federal Trading With the Enemy Act and trying to cover up the trip to Cuba.

Arici was ordered held without bond following a hearing Thursday night in White Plains and Verzani was freed on a $1 million personal recognizance bond.

Verzani travelled to Cuba on September 8, via Cancun, Mexico and remained in Cuba for five days. According to the complaint, Verzani lied about his whereabouts on declaration papers when he returned to the U.S.

Though thousands of Americans now visit Cuba each year, they must meet one of the following criteria to visit legally. Travel is permitted for the following:

  • To visit a close relative
  • To work as a journalist
  • To conduct government business
  • For members of recognized international groups
  • For research and academics
  • To attend professional conferences
  • For telecommunications and agricultural professionals
  • For public performance or athletic competition

Legislation to lift the ban was considered by Congress in 2010 and passed the House Agriculture Committee but stalled in the Senate Foreign Affairs Committee. Proponents of lifting the ban include President Obama who hoped to open up trade with Cuba which is only 90 miles from Florida. Republican opponents of the bill believe that loosening the travel ban will ease pressure on the restrictive Cuban government and prop up an abusive regime.

It is puzzling why federal agents targeted Verzani and Arici at a time when many are calling for the travel bans to be lifted.

OMG! THAT is unbelievable !! gosh! i am so sorry . . . .smilies/angry.gif> Marc is my cousin and I love him and I'm so sorry that he is in this trouble. . . . .He is NOT AT ALL the type to do something that would get him in trouble !!!! He is a great guy-he was probably scared to death and that is why he lied if he did as that is not at ALL LIKE MARC...he is a really good man and he just got into trouble.
LET he who is without sin cast the first stone, allrilght? so all of you who are on YOUR high horse please get off of it and think of the things you do in your own life that you've done wrong and give a fellow American a break, after all. An Italian American and he has a great family and is super loving, kind, gracious, and very very good to his family. He made a wrong turn is all and deserves forgiveness and restitution. I'd say just drop it and say he just can't buy the LAND there. What did he REALLY HURT--eh?

To "The Law is Dumb" - Are you really making that analogy? Seriously?
In this case, the law simply says "do not go to Cuba for reasons other than outlined in the law". That's a little different wouldn't you say?
Now, I do think the law is past its time, and should be revoked. But until that time, it is very simple, follow it.
The gentleman in question is a LAWYER. He shuold know better. Apparently, he feels he is above the law, and sadly, a number of people seem to agree with him.
If you want the law revoked, write your congressperson and Senators.

Obey the Law - So we used to have a law allowing slavery in this country. Should that law have been obeyed simply because it was the law? Here we have a stupid law that is kept in effect to please some Cuban right wingers in Miami and guys like Dick Cheney. What the government should be doing is getting rid of this law rather than prosecuting this fellow. (He was of course foolish to do what he did given the risks he is now facing and was nuts to lie to the feds).

Let me get this straight. This guy is a lawyer, and broke the law to travel to Cuba? And people find fault with the government? Please. The law may be dumb, but it is the law. And a lawyer should respect that.

This guy's problem will turn out to be the fact that he lied to the feds. As a lawyer, that's a really bad thing to do. The Embargo law is despicable and I would argue unconstitutional but it is currently the law. This guy knew what he was doing. But now he and his family will pay the price. He will get disbarred and may well serve some time. I feel bad for his family.

DC, i too as a US citizen would like to buy some beachfront property in Cuba. However it is ILLEGAL right now. I'm sure when, and if it does become legal, prices will soar in an open market. If buying property in Cuba is a necessity right now , I suggest they give up their US citizenship and move elsewhere. Defending someone who intentionally tries to circumvent the law is an all too common problem in society now.

Funny how the people who supposedly want Cuba to drop communism and become capitalistic get mad when someone actually tries to do capitalistic business in Cuba. Instead, they want them to obey U.S. law while on Cuban soil, as if Cuba were owned by the U.S., which is a clear violation of Cuban sovereignty, but I guess they hipocritically think that only U.S. sovereignty is to be respected, and everyone must kow-tow to Washington.

End the stupid embargo and let this guy off. Total waste of taxpayer resources prosecuting him. Better go after the bankers who got us into the subprime mess and the hedge fund insider traders. You can still arrest a bunch of Scarsdalians this way but do something good.
